ENI could face substantial compensation claims following Italy’s €936.7 million biofuel cartel decision.
The Italian Competition Authority found that ENI, Esso, IP, Q8, Saras and Tamoil coordinated the bio-component of fuel prices between 2020 and 2023. ENI received the largest individual fine, at €336.2 million.
The case is now attracting litigation specialists and transport associations preparing collective damages actions for companies that purchased fuel during the alleged cartel period. Some initiatives are structured on a no-win, no-fee basis, reducing the financial risk for claimants.
No definitive compensation figure has yet been established. However, given the scale of the Italian fuel market and the number of potentially affected purchasers, aggregate claims could run into hundreds of millions of euros if significant overcharges are proven.
ENI disputes the competition authority’s findings and is challenging the decision, meaning the eventual financial exposure remains uncertain.
