The legal battle over Italy’s €936 million biofuel cartel decision is entering its next phase.
Oil companies Saras and Tamoil have confirmed that they will appeal to the Consiglio di Stato, Italy’s highest administrative court, following rulings by the TAR Lazio that largely upheld the Italian Competition Authority’s (AGCM) findings.
In May 2026, the TAR Lazio confirmed that several major oil companies had participated in an anti-competitive agreement concerning the “bio-component” included in motor fuel prices. The court upheld the AGCM’s findings against Eni, Kuwait Petroleum (Q8), IP, Saras and Tamoil, while ordering the AGCM to recalculate Esso’s fine and reducing Tamoil’s penalty.
The companies’ appeals are expected to challenge both the AGCM’s assessment of the evidence and the legal interpretation of information exchanges that allegedly facilitated the coordination.
At the time of writing, there has been no public confirmation that Eni has filed an appeal with the Consiglio di Stato, although the company previously challenged the AGCM’s decision before the TAR Lazio and may still decide to pursue a further appeal.
