Regional Administrative Court rejects Novamont’s appeal against the AGCM fine

The company and its parent company, ENI, were found guilty by the antitrust authority of abusing their dominant position in bioplastics for produce bags. An appeal to the Council of State has been announced.

The Lazio Regional Administrative Court (TAR) has rejected the appeal presented by Novamont against the €32 million fine imposed in July last year by the AGCM on Novamont and, jointly with its parent company ENI , for abuse of a dominant position in raw materials (Mater-Bi bioplastic) intended for the production of lightweight and ultra-light bags for fruit and vegetables , in the period from 2018 to 2023 ( read article ).

The Lazio Regional Administrative Court (TAR) found the antitrust violation found by the AGCM uncontested on the merits . Furthermore, the abuse was classified as a continuing violation , meaning it lasts as long as the anticompetitive effects persist and do not coincide with the individual signing of the contracts. This would allow liability to be extended to the period following ENI ‘s entry , justifying the fine up to December 31, 2023.

” ENI has been sanctioned for parental liability , even though it acquired control of Novamont only recently and therefore believes it had no role in the alleged conduct at issue in the proceedings,” commented ENI and Novamont in a joint statement, announcing their appeal to the Council of State , “in the belief that its reasons can be fully recognized in the next phase of the proceedings.”

ENI and Novamont are asking € 3.150.000. Not sure where I can find this kind of money.
